Privacy Policy Agreement
The Agreement
Kandinsky Media is a trading style of Bismuth Limited.
This Privacy Policy Agreement constitutes the entire privacy policy agreement and understanding between you, the individual, and Kandinsky Media (the Parties), with respect to its subject matter and replaces all previous agreements between, or understandings by, the Parties with respect to such subject matter.
General
Kandinsky Media takes your privacy seriously and takes reasonable precautions to safeguard the personal information you supply to it. Kandinsky Media reserves the right to amend its privacy policy without notice.
Data Protection
Kandinsky Media, data hosting and data management company are registered under the Data Protection Act 1998.
Data to be Collected and Uses of the Data
Kandinsky Media collects data about you, and in some cases your interests and subjects you would like to receive communications about. This information is used to assist third-parties in communicating with you about their products and services.
Collection of Data through "Cookies"
When you access any of our web sites we will use what are called "Session Cookies" in order to keep track of your movements through our Web site and to move you faster between individual web pages. The 'Session Cookies' only operate for the duration of the visit to the Web site. After you have left our Web site we do not leave any cookies on your hard drive.
Registration Though Third-parties
The collection of data by Kandinsky Media through registration on third-party web sites, through telephone surveys, mobile communications and other methods of contact and opt-in. This will invariably lead to your data also being held and used by that third-party.
Provision of Your Data to Third Parties
Kandinsky Media collects your name and address, landline telephone, email address, mobile/SMS number and other details in order that third-parties may communicate with you by post, email or telephone, and mobile/pda device using voice, multimedia message, SMS/text or other mobile communication channel. Your data may be released to them for any commercial purpose, including marketing, tracing and fraud prevention.
Provision of Your Data for Enhancement Purposes
Your data may be provided to clients of Kandinsky Media to be appended to information they already hold about you for any commercial purpose, including marketing, tracing and fraud prevention.
Use of Your Data for Analytical and Statistical Purposes
Your data together with that of other subscribers to Kandinsky Media may be aggregated at Postcode or other levels for the building of statistical and analytical tables. At no time will your data be individually identifiable in such tables.
Identification
When communicating with you or allowing a third-party to communicate with you, and where it is deemed appropriate or legal requirements dictate, Kandinsky Media may identify itself to you by its company name 'Bismuth' or its trading style name (being Kandinsky Media etcetera). Furthermore, Kandinsky Media may shorten its identifying name in mobile SMS/multimedia or email communications with you to 'BISM'or 'BISTel'.
Use of External Suppliers
Kandinsky Media may from time to time use third-party suppliers to provide all or part of a service to you. Kandinsky Media shall only be entitled to supply such of your personal information as is necessary to enable them to provide the relevant service to you. You should be aware that such outside service providers might be based in countries outside the European Union whose laws provide for a different standard of protection for your personal data than that provided under English law.
Deregistration
You may at any time deregister from Kandinsky Media by emailing unsubscribe in your subject line to
unsubscribe@kandinskymedia.com
The consequences of deregistration are that your account details will be placed in a suppression file and you will not receive any further communications from Kandinsky Media. We cannot guarantee that your details will not have been passed to a third-party prior to your request.
Legal Requirements to Provide Data
Except as provided above Kandinsky Media will not provide your personal information to any third-party without your prior consent, however, under certain circumstances the force of law may require the provision of information to the legal authorities. In order to maintain the integrity of its data and safeguard the interests of its subscribers Kandinsky Media will comply with any such legally binding request.
Security Of The Internet
The Internet is not a 100% secure medium for communication and, accordingly Kandinsky Media cannot guarantee the security of any information you send to Kandinsky Media via the Internet. Kandinsky Media is not responsible for any loss or damage you or others may suffer as a result of the loss of confidentiality of such information.

Law
This Agreement including the consequences and termination hereof and any proceedings pursuant hereto shall be construed and governed by the laws of the British Virgin Islands and the Parties hereby irrevocably submit to the exclusive jurisdiction of the British Virgin Island Courts
